Frequently Asked Questions (FAQs)

Legal disputes can feel overwhelming. Below, we’ve answered some of the most frequently asked questions about disputes and litigation to help you better understand the process and how we can assist.

Why do I need a will?

A valid Will ensures your assets are distributed according to your wishes, providing clarity and minimising potential disputes amongst loved ones. Without a valid Will, the state determines asset distribution in accordance with with relevant laws, which may not align with your preferences.

What is probate, and why is it necessary?

Probate is the legal process of validating a will and authorising the executor to distribute the estate. It ensures the proper administration of your assets and debts according to your wishes.

Can I update my will?

Yes, Wills can and should be updated to reflect major life changes, such as marriage, divorce, the birth of children, or significant financial changes.

What happens if someone contests my will?

We assist in defending your Will against claims, ensuring your intentions are upheld while addressing concerns made by potential claimants.

What is an Enduring Power of Attorney?

An Enduring Power of Attorney is a legal document that lets you appoint a person(s) who you trust to make decisions on your behalf for personal or financial matters - or both. Personal decisions do not include matters that relate to medical treatment, or to medical research procedures. To appoint a person for medical decisions you will need to complete the steps involved for a Medical Treatment Decision Maker form.
